Joint Petition vs Single Petition Divorce

Joint Petition Divorce

A joint petition is suitable where both parties mutually agree to divorce and have resolved issues relating to children, maintenance, and assets. This process is generally faster and less contentious.

Single Petition Divorce

A single petition may be necessary where there is no mutual consent or where issues remain disputed. This process may involve hearings, evidence, and longer timelines. We will explain the legal implications of each option clearly so you can make an informed decision.

How the Divorce Process Works

01

Initial Consultation

We begin with a confidential discussion to understand your situation, concerns, and objectives.

02

Legal Assessment & Strategy

You will be advised on whether a joint or single petition is appropriate, the documents required, and the expected timeline.

03

Filing & Representation

We prepare and file the necessary court documents and represent you throughout the proceedings, whether in court or negotiations.

04

Resolution & Next Steps

Once the divorce is finalised, we advise on post-divorce matters such as enforcement, variation, or further applications if needed.

How We Approach Divorce Matters

Every family situation is different. We structure divorce arrangements based on real-life needs, not generic formats. Where appropriate, we consider:

  • Clear and practical child access arrangements
  • Maintenance structures that remain workable over time
  • Thoughtful access timing and handover arrangements
  • Schooling and education decision-making
  • Medical and emergency decision clarity
  • Practical maintenance payment methods
  • Interim living and property occupation arrangements
  • Travel and overseas access considerations

Our goal is to reduce uncertainty, conflict, and repeated court applications by addressing issues early and clearly.
